1. Acceptance of Terms

By accessing or using this website and the services provided by the Empire State Building Observatory, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this site.

2. Ticket Purchases

All ticket purchases are subject to availability. Tickets are non-refundable, except as required by applicable law. Reschedules are permitted up to 24 hours before the scheduled visit time via our Manage My Booking portal.

3. Pricing & Booking Fees

A booking fee of $5 (or $2 for CityPASS tickets) is added to each transaction. All prices are listed in U.S. dollars and include applicable taxes unless otherwise stated.

4. Visit Requirements

All visitors must have a valid ticket for a specific date and time slot. Visitors are subject to security screening upon entry. The Empire State Building reserves the right to refuse entry or remove any visitor who violates building policies.

5. Operating Hours

The Observatory is open daily from 9:00 AM to 12:00 AM, with last entry at 11:00 PM. Hours may vary on holidays or due to special events. Visit our Hours of Operation page for the most current schedule.

6. Limitation of Liability

The Empire State Building Observatory is not liable for any indirect, incidental, or consequential damages arising from your visit, except in cases of gross negligence or willful misconduct.
